Hi my tenant was expected to move from my property on the 31st July
2005. However a few days prior to this, i recieved a letter from the
council advising me that the tenant had visited them to explain she
will be homeless and in turn i was sent information about the correct
procedure to evict her in line with a shorthold tennancy agreement.

She is a single mother and is now trying to claim housing benefit. I
have issued a section 21 notice and hope the council will house her
prior to the end of the notice but this seems unlikely. I have recieved
no rent to date for this month and any housing benefit she recieves to
pay me will not cover the rent.

Can i serve a section 8 notice for non payment of rent? This is my
only property and im having to extend my stay at my parents until i can
evict her. I want to find a way to get her out asap. obviously due to
her sitaution - having a young child, Its best she is housed asap and i
can move back into my place as opposed to her having no where to go.
Any help would be appreciated. If a secrtion 8 notice is required then
can i obtain this from somewhere other than visiting a solictor?

Hi, I,m having identical snags with my tenant. In my case, the council
housing officer has virtually admitted that my tenant will not move out and
has been advised to stay as long as possible (With me bearing the cost of
rent and eviction proceedings) as the council are short of housing. I have
been told to go and buy (at even more extra cost) a section 21 notice so
that when it comes to court I stand some chance of getting my own house
back. I am investigating the criteria for section 8 at the moment and will
let you know but if anyone knows where I can download a section 21 I would
be most grateful.

Thanks for the info. Guess there doesnt seem to be to much protection
for landlords. Hope my parents dont ask me to leave any time soon or
ill be homeless. Guess the council would need to house me then!

Firstly you do not mention where you are in the country, whether the property
is let through an agent or direct which makes giving "local" advice difficult.
Secondly I hope as a landlord, and more importantly an investor, you are
offering the property through a recognised lettings agent? If this is not
the case I would suggest you read the following website as it sets what I
believe are basic requirements for all parties involved.
